Privacy policy

The Spark Driver app services privacy statement, last updated December 22, 2025, describes the personal information Walmart collects from independent contractors and applicants through the Spark Driver website and app. Categories include basic identifiers, device and online identifiers, financial information, biometric data such as face geometry, geolocation, background-check information, and communications. The statement explains how the information is used, who it is disclosed to, retention periods, security measures, California privacy rights, and Walmart’s use of automated decision-making technologies.

Return and refund policy

Spark Driver does not sell products to consumers, so a traditional return and refund policy does not apply to the platform. Customer returns are handled through Walmart’s standard return policy.

Terms and conditions

The Spark Driver contract and app terms of use govern the relationship between Walmart and independent contractors using the platform. The agreement is presented during enrollment and must be signed in the app before a driver can accept offers. It covers independent-contractor status, service-level standards, payment terms, deactivation grounds, dispute resolution, and confidentiality. Because the document is delivered through the app rather than posted publicly on the marketing site, drivers can view their executed copy from within the Spark Driver app.

How do I sign up to become a Spark Driver?

To sign up as a Spark Driver, visit the Spark Driver enrollment page and complete the application form. You must be at least 18 years old, have a valid REAL ID-compliant driver’s license, a Social Security number, proof of auto insurance, and a smartphone running iOS or Android 11 or newer. After you submit your application, Spark Driver runs a background check, which typically takes 1 to 7 business days. You’ll receive email updates throughout the review, and once you’re cleared, you can download the Spark Driver app and sign the Spark Driver Contract and App Terms of Use to start accepting offers.

How do I check my Spark Driver application status?

Sign in to the Spark Driver app and open the Enrollment Checklist on the account homepage to see your current status. How do I update my driver's license or auto insurance on Spark Driver?

Open the Spark Driver app, go to Account → Documents, and upload a clear, right-side-up photo of your updated driver’s license or auto insurance card. Make sure the image isn’t cropped and shows your name, the expiration date, and the vehicle information. Spark Driver typically reviews uploaded documents within 1 to 3 business days. Frequently asked questions about Spark Driver

I drove for Spark — am I owed money from the FTC's $100 million Walmart settlement?

Possibly. On February 26, 2026, the FTC and 11 state attorneys general reached a $100 million judgment against Walmart over Spark Driver pay practices, including underpaid tips, modified base pay, and unpaid incentive bonuses going back to January 1, 2021. You do not need to file a claim. According to the FTC, Walmart began issuing direct payments to eligible drivers in mid-2025 based on its internal records, and the FTC will distribute a separate $16.17 million driver fund for the remainder. If you accepted Spark offers between Jan 1, 2021 and Feb 26, 2026 and were paid less than the offer card showed, watch your email from Walmart and check ftc.gov/enforcement/refunds for updates. The FTC will never charge you a fee to receive your money.

Walmart told customers "100% of tips go to the driver" — am I owed a refund as a customer?

Maybe. As part of the same February 2026 settlement, the FTC found that Walmart sometimes failed to pass collected tips to drivers and also did not refund those tips to customers. Of the $100 million judgment, $10 million is earmarked for the FTC to distribute as consumer refunds. No claim form has been announced yet; the FTC says affected customers should monitor ftc.gov/enforcement/refunds for instructions. Do not pay anyone who contacts you offering to “process” your refund — the FTC never charges a fee.

A Spark driver marked my Walmart order as delivered, but I never got it. What do I do?

Start with Walmart, not Spark Driver — Walmart, not the driver, is your contracting party as a customer. Open the Walmart app or walmart.com, go to your order, and use “Help” or chat to request a refund or redelivery; if the order was placed with SNAP/EBT, ask specifically for the refund to return to your EBT card, which Walmart confirms it will do for canceled items. Take screenshots of the delivery photo, the tracking map, and any chat with the shopper before you contact support. If Walmart’s first-line agent refuses, escalate via the executive contacts listed above on this page.

My Spark Driver account was deactivated without warning. How do I appeal?

Spark’s appeal path is in the app: tap the “Account deactivated” banner, scroll to “What if I have further questions or disagree with my deactivation?”, and follow the link to the appeals form. Submit it the same day with any evidence you have — screenshots of completed deliveries, customer chats, on-time metrics. Expect days to weeks for a response; deactivations are described as “typically permanent” but reversible on appeal. If Spark denies the appeal, the next step is arbitration; the pre-arbitration phone call is conducted by an outside attorney and the process can take 60+ days. If the trigger was a Checkr background-check error (wrong-person criminal record, license shown as suspended in error, SSN mismatch), Checkr is legally required to investigate disputes within 30 days under the Fair Credit Reporting Act, and an FCRA attorney can pursue that separately from Spark’s internal appeal. A customer reduced or removed my tip after delivery. Can I get it back?

Not currently. Walmart customers have a 24-hour window after delivery to adjust their tip up or down, and there is no mechanism for drivers to recover a tip that has been pulled. You can report the order number to Spark Support and ask for it to be forwarded to the Trust and Safety team — drivers report that repeat tip-baiters can have customer accounts flagged, though Spark has not confirmed any specific consequence [10]. The February 2026 FTC settlement requires Walmart to implement an earnings verification program and bars the company from modifying base pay or tips after the offer is accepted by Walmart, but it does not change the customer’s 24-hour tip-adjustment window. Keep screenshots of the original offer card and your delivery photo in case the offer itself was modified — that’s a settlement claim, not a tip-baiting one.

 

 

Why won't a Spark driver deliver to my house, and why am I still being charged?

Drivers can drop or cancel an accepted order after arriving — common cited reasons are dogs/pets in view, long driveways, gated entries, stairs, or a customer history of low or no tipping. From the customer side, Walmart should refund the order if it was returned undelivered; if it’s reassigned, the wait can stretch hours. Set the Walmart app to allow substitutions only if you’re comfortable with them, write specific delivery instructions (gate codes, pet-containment notes, doorbell location), and tip up front if you can — drivers see the pre-tip on the offer card, and a $0 pre-tip on a long trip is frequently rejected. If your order has been refused or returned more than once, ask Walmart to flag the address for delivery rather than continuing to retry; if that fails, the executive contacts on this page are the next step.

Someone hijacked my Walmart account and used Spark Driver to ship orders to themselves. What do I do?

Act fast. Walmart has acknowledged repeated account-takeover incidents in which attackers used phishing or credential stuffing — not a breach of Walmart’s systems — to log into customer accounts and place delivery orders charged to saved payment methods. First, dispute the charge with your bank or card issuer immediately and request a replacement card; bank alerts on every transaction will catch the next attempt faster. Second, change your Walmart password to a unique one, enable two-factor authentication, and reset passwords on any other site that shared the same credentials. Third, remove saved payment methods from your Walmart account until you’re confident it’s secure. A separate 2024 breach of the Spark Driver portal exposed driver SSNs and license numbers; affected drivers received two years of free credit monitoring at the time. If you’re a driver and you’ve never been notified but suspect exposure, ask Spark Support to confirm.

I am a Walmart+ customer. I am disabled and need delivery. My main issue is with Spark. For over a year, I have had a problem with Spark drivers who refuse to deliver because I have animals. My driver instructions make it clear that I do not want a scared driver. The excuse I get is they are not allowed to see the instructions until it is too late. I have tried calling the store to ask them to warn drivers to let someone else deliver, but I'm told "We don't have anything to do with the drivers." There is no system in place to avoid this problem. Walmart Chat and calling Walmart's help line do not help. In the past few weeks, I have realized that the drivers are PAID for making the trip, even if they refuse to do their job. I first realized it when I ordered ONLY cat food. I ordered a 30 pound bag of one brand and a 35 pound bag of another, hoping to get at least one. That driver had to know I have cats. A CHILD could look at 2 big bags of cat food, and think, "She probably has a cat." If Spark is so foolish as to pay a person who REFUSES to do her job, that's their business. But please leave me out of it. Pull that stunt on someone else who is able to go to the store. The most recent scammer to pull this knew before she checked out I have animals. As soon as I received the Chat With Your Shopper notice, I began a chat with Breanna who admitted she is terrified, yet she argued with me about letting someone else deliver. I have screenshots of the chat. She came here, then refused to deliver. An express order placed at 3:30 was delivered about 9:30. The driver was very disappointed that there weren't any raccoons there. This sorry "service" is inexcusable. I PAY for this service, yet it has reached the point where I HATE to order from Walmart bc Spark and Walmart cannot cooperate to solve this. There are a number of ways to fix it, but the easiest is for Spark to stop rewarding drivers who refuse to do what they were hired to do. Spark has many outstanding, hard working HONEST drivers. It is grossly unfair to them to pay cheaters. Give me an address, and I will send you that Chat I told you about.

First off I have the proof to Backup what I say
If I do not tip, the Walmart driver, spark driver my order always gets delayed then I have to go to the store and pick it up or it gets canceled. If I do not tip a Walmart driver cause it spark is owned by Walmart they do not bring me my stuff and approving it. I tip them. I get it if I don’t tip them And this is illegal you offer service or product and say how great it is and how reliable it is in your overview yet the same thing happens. You’re not reliable when people aren’t tipping and that’s illegal and the problem is is Walmart don’t care. I’ve contacted Walmart. I’ve contacted you hear a bark. You guys don’t care but that’s OK. I’m now notify the FCC because they don’t care and they’re ripping people off and then don’t have to waste my gas or a reliable service that they say that isn’t reliable and I on disability so I can’t afford to keep running back-and-forth, but Walmart forces me to spark forces me too

Absolute garbage. I am unable to use the app (work) due to a “glitch”. I’ve spoken to support everyday and received several escalation tickets to nowhere. The app says my insurance is expired even though it was submitted and approved. Every time I talk to driver support they say they see it and it is updated but for some reason are unable to correct the glitch. There is no solution and for a company this large they should have people working for them who are actually IT qualified. I am beyond frustrated and their lack of concern is disturbing.

My complaint is Simple my account was deactivated yesterday with their reason being , it was reported i was sharing my account ..How am i sharing my account when i do my own ID verification everytime i am asked to, i have never shared an account in the 3 years i have worked for Spark...So now im out of a income for a reason that never existed..so i have to start a long drawn out Appeal process that will end with a call to the legal team ..this is wrong to treat a delivey driver like this that has had no complaints or problems in 3 years and has maintained a 4.9 or 5 star rating throuhhout my time with spark..VERY VERY DISAPPOINTED IN THIS SITUATION..I HAVE WORKED VERY HARD FOR YOU GUYS TO BE TREATED LIKE THIS!!!
